SECURITY COUNCIL COMMITTEE ADOPTS LIST OF INDIVIDUALS
WHOSE FINANCIAL ASSETS SHOULD BE TRANSFERRED
TO THE DEVELOPMENT FUND FOR IRAQ
NEW YORK, 2 July (UN Headquarters) -- The Chairman of the Security Council Committee established by resolution 661 (1990) concerning the situation between Iraq and Kuwait wishes to inform as follows:
The Security Council Committee established by resolution 661 (1990) concerning the situation between Iraq and Kuwait on 27 June adopted its first list of individuals identified pursuant to paragraphs 19 and 23 of Security Council resolution 1483 (2003). The list of individuals is available at the following url: http://www.un.org/Docs/sc/committees/IraqKuwait/1483_lst.htm. A list of entities to be identified pursuant to paragraphs 19 and 23 of Security Council resolution 1483 (2003) will be issued at a later stage, and will be included together with the list of individuals in a consolidated list of the Committee.
Paragraph 19 of resolution 1483 (2003) states that the Committee shall identify individuals and entities referred to in paragraph 23 of the same resolution. Paragraph 23 states that all Member States in which there are:
(a) funds or other financial assets or economic resources of the previous Government of Iraq or its state bodies, corporations, or agencies, located outside Iraq as of the date of this resolution, or (b) funds or other financial assets or economic resources that have been removed from Iraq, or acquired, by Saddam Hussein or other senior officials of the former Iraqi regime and their immediate family members, including entities owned or controlled, directly or indirectly, by them or by persons acting on their behalf or at their direction, shall freeze without delay those funds or other financial assets or economic resources and, unless these funds or other financial assets or economic resources are themselves the subject of a prior judicial, administrative , or arbitral lien or judgement, immediately cause their transfer to the Development Fund for Iraq.
Finally, it is understood that paragraph 23 of resolution 1483 (2003) does not apply to the funds or other financial assets or economic resources of diplomatic and consular missions of Iraq, and that resolution 1483 does not affect the application of the Vienna Conventions on Diplomatic and Consular Relations of 1961 and 1963 to such funds, other financial assets or economic resources.
The submission of requests to update the list is encouraged and should be channeled through the relevant Permanent Mission to the United Nations. Such requests will be considered by the Committee in accordance with its guidelines for the application of paragraphs 19 and 23 of resolution 1483 (2003).
